Volunteer Marshal — Terms and Conditions, Waiver and Indemnity
This document sets out the terms and conditions that apply to all volunteer course marshals, road marshals, aid station volunteers and other on-course volunteers ("Marshals", "you") assisting City-Bay Fun Run Committee Inc ("the Organiser", "we") at the City-Bay Fun Run ("the Event"). It should be read in full and accepted before you take up any volunteer role on Event day.
By registering as a volunteer and accepting the Terms & Conditions below, you agree to be bound by these terms. If you are under 18, a parent or guardian must also read and accept the Minor Volunteer section near the end of this document.
1. Eligibility and Registration
- Volunteers must register in advance through the Organiser's official volunteer registration process. Unregistered persons will not be permitted to marshal.
- The minimum age to act as an independent course or Traffic Marshal is 18 years. Volunteers aged 14–17 years may assist in a support role (e.g. aid station, cheer squad) only, and must be directly supervised by an adult volunteer at all times.
- Any volunteer under 18 years of age must have this document accepted by a parent or guardian (see the Minor Volunteer section).
- Only adult volunteers (18 years and over), wearing the official hi-vis vest, may be assigned to direct traffic or manage road-crossing points.
- The Organiser reserves the right to decline, reassign or withdraw any volunteer placement at its discretion, including for safety, conduct or insurance reasons.
2. Your Role and Responsibilities
Marshals are essential to the safety and success of the Event. Depending on your assigned position, your responsibilities may include:
• Directing runners and pedestrian traffic along the approved course and keeping participants to the left where directed.
• Clearly marking turns, hazards and course boundaries, and alerting your Marshal Captain to any course issues (e.g. missing signage, obstructions).
• Monitoring participant welfare and alerting event medical officials or the Event control point immediately if a participant appears unwell, injured or distressed.
• Preventing unregistered runners, cyclists, skateboards, scooters or animals (other than guide dogs) from entering the course.
• Providing encouragement and a positive, welcoming presence for all participants, including walkers and children.
• Remaining at your assigned position for the duration of your shift, or until formally released by your Marshal Captain — do not leave your post unattended.
• Reporting any incident, near-miss, hazard or breach of conduct to your Marshal Captain or Event Control as soon as practicable, and completing an incident report if requested.
You are not expected to place yourself in physical danger to fulfil these duties. If a situation exceeds your training or comfort, stand back and call for assistance from event officials, medical teams or police/emergency services.
3. Code of Conduct
All volunteers are expected to:
• Treat all participants, spectators, fellow volunteers, officials and members of the public with courtesy, patience and respect at all times.
• Act in a manner consistent with the values of the Event and the reputation of the Organiser and its sponsors.
• Follow all reasonable directions given by Event officials, Marshal Captains, police and emergency services personnel, even where they differ from your rostered instructions.
• Refrain from discrimination, harassment, bullying or verbal abuse of any kind, including on the basis of race, gender, gender identity, sexual orientation, disability, age or any other protected characteristic.
• Never block, obstruct or interfere with a participant's progress except where necessary for safety or course integrity.
• Not consume alcohol or illicit drugs before or during your shift, and not attend your shift under the influence of any substance that could impair your ability to perform your role safely.
• Refrain from any unauthorised promotional, political or commercial activity ("ambush marketing") while on duty.
Failure to comply with this Code of Conduct may result in immediate removal from your volunteer position and exclusion from future City-Bay Fun Run events.
4. Uniform, Identification and Equipment
- You must wear the official hi-vis vest and/or volunteer identification provided by the Organiser visibly at all times while on duty, and return it at the end of your shift.
- Dress appropriately for the weather and your role — comfortable enclosed shoes are required. Consider layers, sun protection (hat, sunscreen) and wet-weather gear, as most positions are outdoors for the duration of the shift.
- Bring only essential personal belongings. The Organiser does not accept responsibility for volunteers' personal property.
- If issued with equipment such as signage, cones, flags or radios, you are responsible for its care and must return it at the end of your shift.
- Volunteers who have current First Aid qualifications are encouraged to advise their Marshal Captain, but this is not a requirement of the role.
5. Health, Safety and Wellbeing
- You must be medically fit to undertake your assigned role. Please advise the Volunteer Coordinator in advance of any medical condition, injury or limitation relevant to your safety on the day.
- The Organiser monitors weather conditions (including extreme heat, storms and poor air quality) in line with Sports Medicine Australia's Hot Weather Guidelines and reserves the right to delay, shorten, relocate or cancel volunteer duties at short notice in the interests of safety.
- You have a duty of care to yourself as well as to participants. Stay hydrated, take breaks where your role allows, and tell your Marshal Captain immediately if you feel unwell.
- Only cross or direct traffic at points designated and approved by the Organiser and, where applicable, SAPOL or the relevant road authority. Do not take up an unapproved position.
- In an emergency, prioritise your own safety and that of participants over property or equipment, and follow the directions of police, ambulance and event medical personnel.
6. Waiver, Release and Indemnity
In consideration of the Organiser accepting you as a volunteer and permitting you to assist at the Event, you (for yourself, your heirs, executors and administrators) agree with the Organiser and each Event Sponsor that:
- You waive, release and discharge City-Bay Fun Run Committee Inc (the Organiser) and the Event sponsors, including but not limited to Advertiser-News Weekend Publishing Company Pty Limited (Sunday Mail), Advertiser Newspapers Pty Ltd (The Advertiser), Athletics Association of South Australia Inc and Athletics Australia Ltd, and each of their respective officers, employees, contractors, volunteers and agents, from all claims or causes of action you may have (including for negligence) arising from any injury, illness, loss or damage of any kind suffered by you, arising directly or indirectly out of your volunteering at the Event — insofar as this does not breach the relevant provisions of the Australian Consumer Law.
- You indemnify and will keep indemnified the Organiser and each Event Sponsor against all costs, losses or damages arising from or in relation to your attendance or participation as a volunteer at the Event.
- You acknowledge that volunteering at the Event carries inherent risks, including but not limited to exposure to traffic, weather, over-exertion, dehydration and interactions with participants, spectators and road users, and you voluntarily accept those risks.
- You declare that you are medically fit to undertake the volunteer role assigned to you.
- This waiver does not apply to any liability that cannot lawfully be excluded, including liability arising from a breach of a consumer guarantee under the Australian Consumer Law, or from the Organiser's gross negligence or wilful misconduct, to the extent such exclusion is not permitted by law.
7. Medical Treatment
You consent to receive any medical treatment (including transport by ambulance) that Event medical officials or emergency services consider necessary during or after your volunteer shift, and you understand that costs associated with such treatment (e.g. ambulance transport) may not be covered by the Organiser and remain your responsibility unless otherwise required by law.
8. Emergency Contact
You must provide an emergency contact name and phone number as part of your volunteer registration. You agree that the Organiser or its medical representatives may contact that person and share relevant personal information with them in the event of an emergency.
9. Photographic and Media Consent
You consent to the free use of your name, image and voice in any photograph, video, broadcast, telecast or print material produced by the Organiser and/or Event Sponsors in relation to the Event, for promotional and reporting purposes.
10. Privacy
The Organiser collects your personal information (including information provided at volunteer registration) to administer your volunteer role, roster shifts, and communicate with you about the Event, including by SMS or email if you provide these details. Your information will not be disclosed to third parties other than as reasonably necessary for these purposes (for example, to Marshal Captains rostering your shift, or emergency services in the event of an incident), or as otherwise set out in the Organiser's Privacy Policy. You may request access to your personal information by contacting the Organiser using the details on the registration form.
11. Event Changes, Cancellation and Force Majeure
In the event of a force majeure — meaning any act, event or cause beyond the reasonable control of the Organiser, including but not limited to extreme weather, fire, flood, storm, civil emergency, government restriction, epidemic or pandemic — the Organiser may cancel, postpone, relocate or change the format of the Event or your volunteer role. You acknowledge that you will have no claim against the Organiser for any loss you incur as a result, including any travel, equipment or other costs associated with volunteering.
12. Rostering, Briefing and Communication
- You will be sent a confirmation of your shift, position, reporting time, and the name/contact of your Team Leader ahead of Event Day.
- Please check in at your designated location at the start of your shift and check out (returning any vest/equipment) at the end.
- Attend any pre-event briefing relevant to your role — this is where site-specific hazards, instructions and emergency procedures will be explained.
- If you are unable to attend your rostered shift, please notify the Volunteer Coordinator as early as possible so your position can be covered.
Quick Reference — On the Day, Bring:
- Comfortable enclosed shoes and weather-appropriate clothing (layers, hat, sunscreen, wet-weather gear).
- A refillable water bottle and any personal medication.
- Your phone, charged, with your Marshal Captain's contact number saved.
On arrival
- Check in at your designated marshal point and collect your hi-vis vest / equipment.
- Attend your briefing and confirm your exact position and shift end time.
During your shift
- Stay at your post, stay visible, stay hydrated.
- Report incidents, hazards or unwell participants to Event Control immediately.
Emergency
- Life-threatening emergency: call 000 first, then notify your Marshal Captain / Event Control.
- Non-urgent medical concern: radio or phone Event Control / the nearest medical station.
